DMCA Notice Requirements

Filing a Valid DMCA Takedown Notice

To file a valid DMCA notice under Section 512(c) of the Copyright Act, your notice must include all of the following elements:

1. Signature

Physical or electronic signature of the copyright owner or authorized agent

2. Identification of Work

Identification of the copyrighted work claimed to have been infringed

3. Infringing Material

Identification and location of the allegedly infringing material

4. Contact Information

Your address, telephone number, and email address

5. Good Faith Statement

Statement of good faith belief that use is not authorized

6. Accuracy Statement

Statement under penalty of perjury that information is accurate

Required Legal Language

"I have a good faith belief that use of the copyrighted materials described above on the allegedly infringing web pages is not authorized by the copyright owner, its agent, or the law. I swear, under penalty of perjury, that the information in the notification is accurate and that I am the copyright owner or am authorized to act on behalf of the owner of an exclusive right that is allegedly infringed."

Counter-Notification Process

Filing a DMCA Counter-Notification

If you believe your content was removed by mistake or misidentification, you may file a counter-notification under Section 512(g) of the DMCA.

Counter-Notice Requirements

  • • Identification of the material that was removed or disabled
  • • Location where the material appeared before removal
  • • Statement under penalty of perjury of good faith belief
  • • Your name, address, and telephone number
  • • Consent to jurisdiction of Federal District Court
